What is qui tam?


qui tam lawsuit is when private individual assists the government with a prosecution of a case where the government has been allegedly harmed (i.e., defrauded), usually because they have special knowledge or information necessary to the case.  As a reward or incentive, qui tam plaintiffs are typically given a portion of the recovery owed to the government for the wrong the government suffered.  Because the government is always the “real party in interest,” qui tam lawsuits typically involve substantial and ongoing government involvement and/or the right to take over the case at any point
