2021 legislative session - HB 1076 – PAGA Like Bill

Lawmakers wasted no time in introducing a slew of bills aimed at increasing liability across all sectors of Washington’s economy.

Among the most troubling is HB 1076 which allows private citizens to sue on behalf of the government to enforce labor and employment laws in exchange for a portion of the financial award. California is the only state in the nation with a similar law and it has been subject to rampant abuse. Most of the claims are based on hyper-technical violations such as late lunch breaks, incorrect employee ID number on a paycheck, and misclassified bonuses. In the vast majority of cases, the plaintiffs end up with little economic recovery, while trial lawyers reap most of the award.

The measure was heard in the House Labor and Workplace Standards Committee this morning.  The LRC enlisted the expertise of Tom Manzo of the California Business and Industrial Alliance to testify on our behalf. His analysis of the California experience is an excellent warning for Washington. All employers would benefit from watching his three-minute testimony.
